1. Who these terms are between

This website (tdm.brainrev.app) and the YouTube channel THE DECISIVE MOMENT are operated by BrainRev, the sole proprietorship of Yosuke Hirayama, Hamamatsu, Shizuoka, Japan. By using this website you accept these terms. If you do not accept them, please do not use the site.

2. What this site is

This site describes the channel and states how we work. It has no accounts, no sign-in and no shop, and nothing on it is sold to you. Watching the videos themselves happens on YouTube, where YouTube's own Terms of Service apply to you as a viewer.

3. The footage we publish

We publish material released under a free licence or into the public domain, mainly by public agencies and from Wikimedia Commons. The source and its licence are credited at the end of every video and in its description. Where the source licence requires it, our finished video is released under the same licence, and the licence stated on the video itself is the one that governs.

Our own additions — narration, on-screen text, thumbnails, editing and this website's text and design — are ours. Where a video carries a Creative Commons licence, that licence covers the video as published, including those additions.

4. What you may and may not do

• You may reuse a video on the terms of the licence stated on that video, keeping the attribution intact.
• You may quote and link to this website.
• You may not use our material to identify, name, locate, accuse or harass a person who appears in it, and you may not present it as evidence of who someone is.
• You may not scrape or overload this site in a way that interferes with its operation.

5. What the videos are not

Our descriptions stay within what the releasing agency has published. Nothing on the channel or this site is legal, security or safety advice, and nothing on it is an allegation against any person. An appearance in a video is not a statement that the person did anything.

6. Takedown and correction

If you appear in a video and want it removed, if you hold rights in material we have used and believe we have used it wrongly, or if something we have written is factually wrong, write to [email protected]. Tell us which video and what is wrong. We act on these; we do not require a formal legal notice first.

7. No warranty, and limits

This website is provided as it is. We do not warrant that it will be available without interruption or that it is free of errors. To the extent Japanese law allows, we are not liable for indirect or consequential loss arising from use of this site. Nothing here limits liability that cannot be limited by law.

8. Changes

We may change these terms. The effective date at the top will change when we do, and material changes will be stated plainly.

9. Governing law

These terms are governed by the law of Japan. The Shizuoka District Court shall have exclusive jurisdiction as the court of first instance for any dispute arising from them.
